How are responsibilities divided in Belgium?
The first level is medical: the doctor officially determines death. The second is municipal, because the registrar of the place of death draws up the extract and gives domestic approvals after the application. The third is a federal international procedure, in which FPS Public Health issues a laissez-passer mortuaire.
Regional law adds rules on coffin and mode of transport. The official Flemish instructions explicitly state that the procedure depends on the destination and on the regulations of the region to which the case belongs.
| Level | Responsible authority | Document or decision |
|---|---|---|
| Medical | doctor who certifies death | official medical certificate |
| Municipal | registrar of the municipality where the death occurred | extract from the death register and domestic approvals |
| Regional | competent Belgian region | packaging and local transport rules |
| Federal | FPS Public Health / Saniport | laissez-passer mortuaire for international departure |
Why is a Belgian extract a prerequisite and not a travel permit?
The Belgian state portal states that the death is reported to the registry office of the municipality where it occurred. The Flemish administration further explains that the certificate proves the death and identity of the deceased and precedes the permit for transport, burial or cremation.
The city of Brussels shows a local application: reporting a death enables the drawing up of an extract and the issuing of authorisation for burial or cremation. That example is useful for the case within the city limits, but another Belgian municipality may have its own transmission channel.
What is laissez-passer mortuaire in the Belgian system?
FPS Public Health states that for the transfer of the deceased to another country it is necessary to request a laissez-passer mortuaire. The federal service publishes an electronic form and special instructions for issuance. The travel document differs from the municipal certificate: it is intended for the international movement of the deceased and accompanies an individual case.
The electronic flow does not mean that all supporting documents are only digital, nor that the originals lose their importance. The request includes identity, death certificate, health information, destination and technical proof. If the content of the document deviates from the extract, electronic submission does not correct the error; the submission is returned to the appropriate issuer.
How does Belgian multilingualism affect documentation?
Names may appear in French, Dutch or German. The terms laissez-passer mortuaire and lijkenpas refer to an international travel document in different language settings, while acte de décès and akte van overlijden refer to a death certificate. A translation should preserve the distinction between those functions.
The language of the form does not itself determine jurisdiction. It is determined according to the place of death, the region and the authority that leads the specific step.
Why is the country of destination checked before the Belgian request?
The Flemish official instruction separates transport within the Benelux, towards the countries of the Strasbourg Agreement and towards other countries. This means that the technical conditions and legal basis are not the same for every destination. The official table of the Council of Europe is used to check whether a particular country is a contracting party.
Serbia, Bosnia and Herzegovina, Croatia and Montenegro have their own consular instructions for entry for burial. The Belgian travel document does not determine the intended cemetery or replace the destination country’s consular document. The country and city of burial are therefore determined before the Belgian international application is submitted.
What is required for the initial Belgian case check?
The correct municipality and institution of death, identification document, civil registration status and full destination of burial are required. If a statement has already been issued, all names and dates are checked. The information about the region makes it possible to find the rule that actually applies, instead of applying the instruction from Flanders to Brussels or Wallonia.
Fenjer Bestattung collects routine documents without a separate handling fee. The 48-hour arrival timeframe applies only to a straightforward case once the Belgian travel document and the authorisation required by the country of burial have been issued. Court proceedings, exhumation and special public-health measures follow separate official procedures and fall outside that timeframe. Fees charged by authorities or other institutions are paid according to their actual invoice.
In the first check, the function of the Belgian form is not guessed by the colour or language of the header. The full name of the issuer indicates whether the document originates from a municipality, regional administration or federal health service. This difference determines what has already been completed and what public step has yet to be initiated.
Process for this case
- Step 1 of 5
Fix the competent Belgian authorities
The location determines both the municipal civil registrar and the region whose transport rules apply.
- Step 2 of 5
Create the civil-status record
The doctor’s evidence supports the municipal declaration from which the death extract is produced.
- Step 3 of 5
Submit the federal outward application
FPS Public Health assesses the Belgian request and its prescribed supporting papers.
- Step 4 of 5
Add the receiving state’s paper
The competent foreign mission checks entry for burial at the named location.
- Step 5 of 5
Match delivery to the completed file
Delivery is made to the consignee recorded in the final set of papers.

Frequently asked questions
What supports civil registration of a death in Belgium?
The application is based on a doctor's certificate, and the registry office of the municipality of death draws up the appropriate act.
Is acte de décès the same as laissez-passer mortuaire?
It is not. The first is a civil death certificate, and the second is a federal document for international transport.
Who issues the Belgian international document?
FPS Public Health manages the laissez-passer mortuaire procedure and publishes the official form.
Are the Flemish rules automatically valid in Brussels and Wallonia?
No. The Flemish instruction confirms regional jurisdiction, so the competent region’s own source must be checked for a case elsewhere.
Why is the city of burial listed before submission?
The destination determines the international regime, the content of the travel document and the destination consular request.
Can an electronic form replace a non-existent original?
No. The digital channel transmits the request, but any attached data must still originate from the competent issuer.
When does the stated 48-hour timeframe for arrival from Belgium apply?
It applies once the municipal, federal and destination-country procedures are complete and no additional official decision is pending.
